Rezoning Your Property

All properties within the City of Lenexa carry a zoning classification that governs the use and development of the land. Lenexa's classifications generally include agricultural, residential, commercial, and business park (industrial) districts. In order to develop a property for something other than that permitted by the existing zoning classification, application must be made to request that the property be rezoned. Potential alternative uses of land may be determined by referring to the Lenexa Comprehensive Plan.

Procedure

First contact the Land Use Division of the Department of Community Development and schedule a pre-application meeting to review your conceptual drawings and the City's requirements and procedures. Then submit a completed application form, along with either a conceptual plan, preliminary plan or a preliminary plat drawing and support documents as outlined in the corresponding application checklist. Applications may be filed at the Planning and Development Department any time between the hours of 8 a.m. and 5 p.m. on or before the filing deadline date. Late submittals will be placed on the next available agenda.

After the City staff reviews your submittal and you have responded to staff comments, your case will be heard by the Planning Commission, which includes a public hearing. The Planning Commission will make a recommendation for approval, approval with conditions, or denial to the Governing Body, who will then make the final decision. If the applicant is anyone other than the fee simple owner, an affidavit must be filed at the time of application with the signature of the fee simple owner designating the applicant as the authorized agent for all matters concerning a rezoning and/or special use request. The project will be reviewed for compliance with the Comprehensive Plan, all City codes and standards, and compatibility with the surrounding properties.
