Section 1-1-D-4 DEFINITIONS AND RULES OF CONSTRUCTION - P - R.

PERSON: Includes a firm, partnership, association of persons, corporation, organization or any other group acting as a unit, as well as an individual.

PROPERTY: Includes real, personal and mixed property.

PUBLIC OFFICER: Includes the following, whether elected or appointed:

  1. An executive, administrative officer or department head of the City.
  2. A member of the Governing Body of the City.
  3. A judicial officer, which shall include a judge, the Municipal Judge, a magistrate, juror, master or any other person appointed by a judge or court to hear or determine a cause of controversy.
  4. A hearing officer, which shall include any person authorized by law or private agreement to hear or determine a cause or controversy and who is not a judicial officer.
  5. A law enforcement officer or public safety officer.
  6. Any other person exercising the functions of a public officer under color of right.

QUALIFIED ELECTOR: Every citizen of the United States who has attained the age of eighteen (18) years and who resides in the voting area in which he or she seeks to vote and who has not been convicted of a felony under the laws of any state or the United States, unless pardoned or restored to his or her civil rights, shall be deemed a qualified elector.

REAL PROPERTY: Includes lands, tenements and hereditaments and all rights thereto and interest therein, equitable as well as legal.
